My van is only worth about $700.00 and I don’t know if we should call the other guy’s insurance or my insurance, or an attorney. The police report listed the OTHER driver first and the officer told my bf that the insurance Co. counts that as who was at fault sometimes….even though neither were ticketed because, officer did not see it.
This is very confusing. I’m glad there are no injuries and it is only damage. Should we try contacting the guy who hit him or his insurance? I don’t want to be harassing him.
Bad situation, I guess.

The first thing my BF’s insurance people asked was “Who was listed firston the report?” They also said that my insurance would probably not do anything for me, but raise my rates. I have basic coverage and so does BF.

I don’t usually like the idea of attorneys, but I feel like this guy should be off the road, and that my frustration, injury, and vehicle deserve some sort of compensation for the shear negligence of the other motorist. He is insured.
Is it worth my time to seek an attorney? If so, will they help with the medical expenses and compensation for the incident? Thanks.

I want to take someone to small claims court (regarding an auto accident — see my previous question if you like), however I would like to speak to an attorney before that (I’m still a bit confused about the law … the insurance companies are telling me stuff that is completely contradictory to what people on this site and others told me — thats why i think legal advice would be helpful).
Most “auto accident” attorneys that provide “free initial consultations” want you to be physically injured (since those cases end up being a lot bigger). My total dispute is about $1500 (and I refuse to lie and come up with the “stiff neck” story), so a person who deals with physical injuries probably wont be interested in my case.
Does anyone know where I can find free/low cost help? I am in the bay area in california? Or, if you are a lawyer in the bay area, ……………………..
